Description
Examine insurance statutes and regulations that apply to an agent’s legal and ethical responsibility to an insured, claimant, insurer,
and other agents. Analyze the potential conflict of interest that exists in the agent-consumer transaction. This conflict is complicated
by a system in which agents are encouraged to provide needs analysis and risk management services to clients; however, his or her
compensation or reward system is sales, not service. Identify ways in which an agent’s or insurance company’s potential legal
liability is changed by insurance laws, society’s perspective of responsibility during the insurance transaction, and court
interpretations.
